ILF protects large ukrainian tobacco industry manufacturer in customs dispute

ILF lawyer Sviatoslav Bartosh under the guidance of ILF partner Serhiy Silchenko represented a large national manufacturer of tobacco products in a dispute with fiscal authorities regarding the classification of imported goods.

The dispute arose after the customs audit department of the main office of the State Fiscal Service in Kharkiv Oblast conducted a remote inspection of ILF’s client. Due to erroneous interpretation of the Main Interpretation Rules of goods classification codes for foreign business activities by the officials of said department, a decision was reached to change the codes of imported equipment. This led to increased import duty. However, after reviewing the complaint, the Appellation Commission of the State Fiscal Service confirmed the validity of the importer’s position regarding goods classification.

At the end of February, the Appellation Commission satisfied ILF client’s complaint against the decision of the State Fiscal Service.
